Official Rules govern all who enter the Cragun's Resort "Vacation Memories
Giveaway" Spring/Summer 2009 Sweepstakes. NO PURCHASE IS NECESSARY TO
ENTER OR WIN. VOID where prohibited. OPEN TO LEGAL RESIDENTS of the USA who
are 21 years of age or older on April 2, 2009. In order to be eligible
to win a prize in this Sweepstakes, you must first enter according to these
Rules. In entering this Sweepstakes, you hereby agree to be bound hereunder
and to abide by all of the Rules listed herein. Your entry signifies your
full acceptance and complete agreement with of all of these Rules. 1. Introduction When you enter this Sweepstakes, your e-mail address will automatically be subscribed to Cragun's free e-mail newsletter. You may unsubscribe at any time by following the instructions included in each newsletter. Your e-mail address and entry information will never be given or sold to any third party or entity. Also, by entering this Sweepstakes, you give us permission to send you e-mail. 2. Eligibility a) This is open only to legal residents residing in the USA who are 21 years of age or older on April 2, 2009. Void in states where prohibited by law. All Federal, State and local laws and regulations apply. b) Employees of Cragun's Resort and their advertising and promotion agencies (and their immediate families and/or household members of each of the above) are not eligible to enter or win. c) Any entry containing false or fraudulent information will be rejected and deleted. Sponsor will disqualify any entry from a person who is under the age of 21 years old as of April 2, 2009. 3. How to Enter a) All eligible entrants may participate in this Sweepstakes by entering via the Web page entry form. This Web page entry form is the only means of entering this Sweepstakes. Attempting to enter by any other means will result in an invalid entry. b) The Sweepstakes begins April 2, 2009 at 12:01 a.m. Central Daylight time (CDT). The "authorized account holder" of the e-mail address submitted at the time of entry shall determine the entrant. Multiple individual's entries from the same e-mail address will void all entries from that e-mail address; the entrant of that e-mail address may be disqualified. f) Sponsor is not responsible for lost, late, damaged, misdirected or incomplete entries. Approximate Retail Value: $198 3 - Memorial Day Weekend - Four day, three night stay for two adults and up to two kids ages 12 and under. Expires May 25, 2009. Approximate Retail Value: $375 4 - Lakeview Room Midweek Package - Three day, two night MIDWEEK stay (Sunday-Thursday) for two adults and up to two kids ages 12 and under. Expires June 19, 2009. Approximate Retail Value: $298 5 - Cabin Midweek Package - Three day, two night MIDWEEK stay (Sunday-Thursday) for two adults and up to two kids ages 12 and under. Expires June 19, 2009. Approximate Retail Value: $298 7 - Father's Day Weekend - Three day, two night stay for two adults and up to two kids ages 12 and under. Expires June 21, 2009. Approximate Retail Value: $298 8 - Family Fun Pak Midweek Package - Six day, five night MIDWEEK stay (Sunday-Thursday) for two adults and up to two kids ages 12 and under. Expires June 30, 2009. Approximate Retail Value: $545 9 - 4th of July Package - Five day, four night stay for two adults and up to two kids ages 12 and under. Expires July 5, 2009. Approximate Retail Value: $596 10 - Lakeview Room Midweek Package - Three day, two night MIDWEEK stay (Sunday-Thursday) for two adults and up to two kids ages 12 and under. Expires August 15, 2009. Approximate Retail Value: $338 11 - Cabin Midweek Package - Three day, two night MIDWEEK stay (Sunday-Thursday) for two adults and up to two kids ages 12 and under. Expires August 15, 2009. Approximate Retail Value: $645 14 - Summer Getaway Weekend - Four day, three night stay for two adults and up to two kids ages 12 and under. Expires August 30, 2009. Approximate Retail Value: $447 15 - Summer Saver Package - Three day, two night MIDWEEK stay for two adults and up to two kids ages 12 and under. Expires September 3, 2009. Approximate Retail Value: $238 16 - Summer Getaway Weekend - Four day, three night stay for two adults and up to two kids ages 12 and under. Expires August 30, 2009. Approximate Retail Value: $447 17 - Legacy Golf Midweek Package - Two day, one 18-hole golf round, one night MIDWEEK stay (Sunday-Thursday) for two adults. Expires September 5, 2009. Approximate Retail Value: $258 18 - Labor Day Weekend - Four day, three night stay for two adults and up to two kids ages 12 and under. Expires September 7, 2009. Approximate Retail Value: $375 19 - Legacy Golf Midweek Package - Two day, one 18-hole golf round, one night MIDWEEK stay (Sunday-Thursday) for two adults. Expires September 26, 2009. Approximate Retail Value: $238 20 - Romantic Getaway - Three day, two night stay for two adults. Expires October 25, 2009. Approximate Retail Value: $358 21 - Legacy Golf Midweek Package - Two day, one 18-hole golf round, one night MIDWEEK stay (Sunday-Thursday) for two adults. Expires October 18, 2009. Approximate Retail Value: $198 22 - Cabin Midweek Package - Three day, two night MIDWEEK stay (Sunday-Thursday) for two adults and up to two kids ages 12 and under. Expires October 31, 2009. Approximate Retail Value: $358 23 - Fun With Friends Getaway - Three day, two night stay for two adults. Expires November 1, 2009. Approximate Retail Value: $398 24 - Fall Fun Weekend - Three day, two night stay for two adults and up to two kids ages 12 and under. Expires November 1, 2009. Approximate Retail Value: $290 25 - Halloween Spooktacular Weekend - Three day, two night stay for two adults and up to two kids ages 12 and under. Expires November 1, 2009. Approximate Retail Value: $290 26 - Girlfriends Spa Getaway - Three day, two night stay for two adults. Expires November 1, 2009. Approximate Retail Value: $500 b) Getaway prizes are subject to availability and may contain restrictions and/or blackout periods. c) Accommodations are offered on a space available basis. Advance reservations are required. Restrictions and blackout period may apply. d) TRANSPORTATION IS NOT INCLUDED - Transportation to and from Cragun's Resort from the winners' point of origin is not included in the prize. Winners are responsible for their own transportation from their point of origin to Cragun's Resort. 5. Selections of Winners a) Winners shall be determined by multiple random drawings conducted once each week. THE ODDS OF WINNING WILL DEPEND UPON THE NUMBER OF VALID ENTRIES RECEIVED AT THE TIME OF EACH DRAWING. (A "Valid Entry" is an entry that is entered in accordance with the Rules of this Sweepstakes). b) Only one (1) prize will be awarded to any one household. Upon winning any prize herein, any other members of the same household or address shall be disqualified from winning any other prize(s) in this Sweepstakes. c) The drawing will be conducted by Cragun's Resort, the judges of this, whose decisions are final and binding in all matters relating to this. Winners will be notified by e-mail and or telephone. d) Prize winners will be required to sign and return an Affidavit of Eligibility and a Liability/Publicity Release, within 10 days of prize notification or prize will be forfeited. If any prize or prize notification is returned as undeliverable, such prize will be forfeited. e) Each getaway Prize Winner may be issued an IRS Form 1099 for the ARV of the prize. Winners are solely responsible for all applicable local, state and federal taxes. 6. Prize Acceptance a) The prizes are not transferable. No substitution or cash redemption allowed. b) By accepting the Prize, the Prize Winners further agrees to release Cragun's Resort, their parents, subsidiaries, affiliates, distributors and related companies and each of their respective officers, directors, employees and agents (the "Parties") from any and all liability, loss or damage of any kind arising out of or in connection with the Prize Winners participation in this, or with respect to awarding, receipt, possession, use and/or misuse of any prize or participation in prize-related activities. c) By accepting the Prize, the Winner further acknowledges that the Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied in fact or in law, relative to prize or to any portion thereof, including, but not limited to, its quality, merchantability, mechanical condition, or fitness for a particular purpose. d) In the case of unavailability of any prize, the Sponsor reserves the right to substitute a prize of equal or greater value. 7. Sponsors Sponsor is Cragun's Resort, 11000 Craguns Drive, Brainerd, MN 56401. 8. General Provisions a) The Sweepstakes is subject to all applicable Federal, State and local laws and regulations. By entering and/or accepting prizes, entrants/prize winners agree to be bound by these rules and the decisions of the Sponsors, and waive any right to claim ambiguity in these official rules. b) Any depiction of prizes is for illustrative purposes only. c) Sweepstakes parties are not responsible for lost, late, misdirected, incorrectly addressed or incomplete on-line entries due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or on-line entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, or faulty transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers or computer equipment. d) Sweepstakes parties are not responsible for entries not received by Sponsor on account of technical problems or traffic congestion on the Internet, or at a Website, or any combination thereof, including any injury or damage to entrant's or any other entrant's computer related to or resulting from entering the Sweepstakes or downloading any material for the Sweepstakes, or other telecommunications malfunctions which may limit an entrant's ability to participate. e) Sponsor may prohibit an entrant from participating in the winning of a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor's representatives. f) Entrants who violate these Official Rules or engage in any conduct that is detrimental or unfair to Sponsor, this or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Sweepstakes. g) If for any reason the Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then the Sponsor reserve the right, at its sole discretion to cancel, terminate, modify or suspend the and shall not be required to award substitute prizes. h) CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. 9. Privacy Policy & Our Publication of Winner Information As a prize winner herein, you agree to the use by Cragun's Resort, of your name and photograph in the prize winners' lists and for other promotional purposes to be determined by Cragun's Resort. YOUR PHOTOGRAPH, FULL NAME, CITY AND STATE OF RESIDENCE, FACE, VOICE AND/OR LIKENESS MAY BE USED IN PRINT OR ON THE AIR AS WE DEEM APPROPRIATE AND ENTERING AND/OR ACCEPTING ANY PRIZE, YOU HEREBY GRANT US THE RIGHT TO DO SO WITHOUT FURTHER NOTICE TO YOU. Information such as your telephone number and street address will not be made public. Winners further specifically agree that use by Cragun's Resort of their name, voice, face or likeness or use of their descriptions in any way and through any means now known or later devised, will not be deemed a violation of their privacy or individual intellectual property rights. The validity and operation of this rule will continue past the duration of the Sweepstakes and will survive (and winners agree to be bound by this rule) in perpetuity. 10. Revision of Rules Cragun's Resort reserve the right to modify these Rules at any time during this Sweepstakes. 11.
